HSP Customer Agreement The HomeOwner Support Program (“HSP”) provides Sea Oaks’ residents (“Homeowner”) with real-time solutions to Identify Insured Property, Mitigate Risk & Expedite Repairs. The Sea Oaks Property Owners Association, Inc. (“SOPOA”) supports HSP, as a voluntary program for its residences, to help coordinate overall repairs in the event of a loss to the common property insured by SOPOA and the Homeowners’ individually owned property.
By clicking “Submit” and paying the Initial Registration Fee, Homeowner agrees to be bound by the terms of this Agreement. Enrollment in HSP allows Homeowner to receive an initial Home Survey, which works to identify the unique characteristics and layout specific to their unit. Registered Homeowners will have access to a secured online system that stores this information as well as other documentation which the Homeowner can upload, manage and otherwise utilize.
To participate in HSP with the required Home Survey and user access to the online system, Homeowner must register and submit an initial one-time registration fee (“Enrollment Fee”) of $135.00 per individual property unit. The Open Enrollment Period for Sea Oaks’ Residence extends from May 8, 2017 thru August 1, 2017 sign up period. Due to logistical and scheduling considerations, the registration fee after the August 1, 2017 initial enrollment period is $199.00. Upon completion of the Home Survey by Synergy, the Enrollment Fee is non-refundable. An annual maintenance service charge of $19.99 will be billed (per individual property unit and after the first year of enrollment) to maintain user access to the Home Survey Information and to maintain eligibility for Sea Oak’s Response & Recovery Programs (under specific individual terms and conditions as defined by an Insurance Claim or Loss).
By accessing or using this software program as part of HSP, you agree to provide access to your unit (at the scheduled appointment date/time) as required to complete the initial Home Survey. If you are accepting these terms on behalf of another person or company or other legal entity, you represent and warrant that you have full authority to bind that person, company or legal entity to these terms.
Homeowner agrees that a Synergy Home Survey technician can access Homeowner’s property to visually document interior &/or exterior structural elements specific to the property/unit in order to provide information necessary to support pre-planned emergency response needs and recovery services. Photos &/or other forms of documentation will be recorded for upload to the HSP secured online system. All fixtures, furnishings &/or personal property/contents that are in-the-open (plain view) may be documented and are not protected under any privacy laws or restrictions. No property or contents will be moved or manipulated in any way. Homeowner agrees that, during the Home Survey, any and all contents and/or property-in-the-open not intended to be documented will be secured outside of plain view in drawers or behind locked cabinets and doors. Homeowner and limited Synergy support staff are the only parties that will have access to their specific Home Survey Information & Documentation, unless otherwise authorized under separate written agreement.
The HSP can be canceled at any time by the Homeowner by written request or email. Upon individual written request for termination of the program, all information and photos as part of the Home Survey will continue to be made available via the online system for 30 days at no additional charge or penalty. It is Homeowner’s responsibility to access and download the information before their account is removed. Any pending annual fees will no longer be billed &/or applicable.
DISCLAIMER: Except for the limited warranty set forth above, the software is provided “as is” and SynergyID or SOPOA makes no representations or warranties, and SynergyID disclaims all representations, warranties, and conditions, oral or written, express or implied, arising from course of dealing, course of performance, or usage in trade, or otherwise, including, without limitation, implied warranties of merchantability, quality, fitness for a particular purpose, title, non-infringement, or systems integration. Without limiting the foregoing, SynergyID or SOPOA makes no warranty, representation, or guarantee as to the software’s use or performance and does not warrant, represent, or guarantee that the operation of the software will be fail-safe, uninterrupted, or free from errors or defects or that the software will protect against all possible threats. Under no circumstances and under no legal theory, whether in tort, negligence, contract or otherwise, shall either party be liable to the other under this agreement or in connection with its subject matter for any indirect, special, incidental, punitive, exemplary, consequential, or extra-contractual damages of any kind, loss of goodwill, loss of personnel salaries, lost profits or revenue, damages due to work stoppage and/or computer failure or malfunction, and/or costs of procuring substitute software or services, whether or not foreseeable, even if the exclusive remedies provided by this agreement fail of their essential purpose and even if either party has been advised of the possibility or probability of such damage.
